Terms & Conditions

§ 1 Scope

These Terms & Conditions apply to all contracts between Valon Jusufi (the "Provider"), Maccostraße 29A, 57080 Siegen, Germany, trading as sevclick, and the client ("Client") for email marketing services. Deviating terms proposed by the Client are not recognized unless the Provider expressly agrees to them in writing.

§ 2 Scope of Services

The Provider offers, depending on the package selected: campaign strategy and creation, setup of automations (e.g. welcome sequences, abandoned cart flows), list segmentation, A/B testing, and monthly performance reporting. The exact scope of services results from the selected package or an individual proposal.

§ 3 Formation of Contract

A contract is formed when the Client accepts a written proposal from the Provider, or the Provider issues an order confirmation by email. Initial consultations and discussions are non-binding and do not constitute a contract.

§ 4 Fees and Payment

The fees agreed at the time the contract is formed apply. All prices are stated in US dollars (USD) unless otherwise agreed. Invoices are due within 14 days of the invoice date, unless otherwise agreed, without deduction.

§ 5 Term and Termination

Contracts run on a monthly basis and automatically renew for another month unless terminated. Termination is possible with 14 days' notice to the end of the month by email to hello@sevclick.com. There is no minimum contract term.

§ 6 Client Cooperation

The Client shall provide all information, access, and materials required for the Provider's services (e.g. access to Klaviyo, brand guidelines, product information) in a timely manner. Delays caused by the Client's lack of cooperation are not the responsibility of the Provider.

§ 7 Liability

The Provider is liable without limitation for intent and gross negligence, and under applicable product liability law. For ordinary negligence, the Provider is only liable for breach of a material contractual obligation, limited to the foreseeable, contract-typical damage. No guarantee is given regarding specific revenue or open rate outcomes, as these depend on numerous factors outside the Provider's control.

§ 8 Data Protection

The processing of personal data in connection with the performance of the contract is governed by the Provider's Privacy Policy, available at sevclick.com/privacy-policy.html. Where required, the parties will enter into a data processing agreement in accordance with Article 28 GDPR.

§ 9 Final Provisions

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
